Weather information and maritime transport risk refers to the operational process of connecting weather and sea-state information—such as typhoons, developing low-pressure systems, strong winds, storms, waves, swell, storm surge, fog, restricted visibility and icing—to vessel schedules, port operations, cargo damage, additional costs, marine cargo insurance, carrier liability and incident response.
Weather is not merely background information in maritime transport. It may result in vessel slowdown, weather routing, deviation, postponed departure, anchorage waiting, port-entry restriction, berth delay, suspension of cargo handling, port closure, port omission, port rotation change, transshipment delay, CY or CFS suspension and interruption of domestic delivery.
The effect is not limited to delay. Strong winds, waves, seawater ingress, storm surge, flooding, rainwater, condensation, cargo shifting, container damage, loss of reefer power or temperature deviation may cause physical cargo damage.
A freight forwarder, NVOCC, shipper, cargo owner, warehouse, customs broker, delivery provider and insurance practitioner should therefore use weather information as operational information for identifying the affected transport stage, cargo location, pending event, possible damage and records that must be preserved.
The existence of a typhoon or heavy weather does not automatically establish the cause of delay, cause of cargo damage, carrier exemption, freight forwarder responsibility or marine cargo insurance coverage. The weather conditions, actual vessel operation, port operation, cargo status, contract and incident records must be examined separately.

The existence of a weather-related cost and the right to recover it from the shipping line, NVOCC, freight forwarder, shipper, cargo owner or another party are separate issues.

Relationship with Marine Cargo Insurance
Delay to a vessel or delivery caused by typhoon, heavy weather or port closure may not by itself be covered by ordinary marine cargo insurance.
Where physical cargo damage occurs, including seawater damage, container damage, cargo shifting, storm-surge flooding, handling damage or reefer temperature deviation, the insurance conditions and cause of loss must be reviewed.

Heavy weather, typhoon, perils of the sea or force majeure may be relevant to a carrier's defence or limitation of liability.

Weather evidence may establish the existence and severity of heavy weather. It does not alone determine whether the carrier is liable or exempt.
Relationship with General Average
Where an extraordinary sacrifice or expenditure is reasonably made to preserve the vessel and cargo from a common peril during heavy weather or another marine casualty, a general-average issue may arise.
A typhoon encounter, vessel delay or cargo damage does not by itself constitute general average.

Contractual status, the actual scope of entrusted work, physical operations, business attributes, names appearing on transport documents, insurance status, applicable terms and mandatory law must be examined separately from the Standard Five Classifications. These matters do not constitute a sixth classification or any additional classification.
It is necessary to identify who is the Contracting Carrier, who is the Actual Carrier, who obtained the booking, who reviewed weather, port and vessel information, who arranged CY delivery, customs, storage, reefer power, pickup and delivery, who received the incident notice and who approved the alternative measure.
It is also necessary to determine whether the freight forwarder only communicated a notice received from the shipping line, had contractual authority to select a route or alternative transport, or was entrusted with D/O, pickup, storage, delivery or insurance notification.
Responsibility cannot be determined solely from a party's description as a shipping line, NVOCC, prime freight forwarder, overseas agent or customs broker. The contract, transport documents, applicable terms, entrusted work, notice timing and response after the incident became known must be reviewed.

Example 1: Heavy-Weather Defence and Inadequate Securing
Assume that industrial machinery is imported from East Asia to Yokohama. A developing low-pressure system and high waves affect the voyage, and the machinery is found overturned inside its wooden case at destination.
The shipping line states that the vessel encountered severe heavy weather and refers to possible perils-of-the-sea or force-majeure defences.
The cargo owner is then advised that the internal bolts and cushioning may have been insufficient. It remains unclear whether the damage resulted primarily from weather, packaging or cargo securing.
The estimated machinery repair cost is JPY 4.2 million, with domestic movement and reinstallation estimated at JPY 800,000.
The existence of heavy weather does not establish either carrier exemption or packaging responsibility.
The marine warning, waves, vessel route and voyage record should be reviewed together with the case design, bolts, cushioning, internal securing, EIR, arrival photographs and survey report.
If the packaging could not withstand ordinary transport, the heavy weather may have exposed an existing packaging deficiency. If appropriate packaging and exceptional sea conditions are established, a different liability analysis may apply.
The freight forwarder should not admit liability, should notify the relevant parties and should preserve the opportunity for inspection before repair or movement.
Example 2: Typhoon Delay, Reefer Dwell and Temperature Deviation
Assume that frozen food is imported to Japan through Singapore. A typhoon causes suspension of terminal operations at the transshipment port, and connection to the next vessel is delayed by four days.
The reefer set point is minus 18 degrees Celsius, but the temperature record temporarily rises to minus 10 degrees during the transshipment dwell.
The cargo owner asserts that the entire cargo is unfit because of the typhoon delay and requests an insurance claim for the full invoice value of JPY 9 million.
However, the record shows several short temperature increases followed by recovery. The cargo-core temperature, loading temperature, power record and alarm response remain unconfirmed.
The typhoon delay and a total loss must be examined separately.
The PTI, set point, supply air, return air, power connection, alarm, yard position, cargo-core temperature, inspection and expert quality assessment should be reviewed.
Where some cargo may remain usable, segregation and loss mitigation should be considered before disposal. The freight forwarder should notify the insurer, carrier, transshipment agent and surveyor promptly.
Example 3: Storm-Surge Flooding in a Container Yard
Assume that a laden export container is delivered to a regional CY and the yard is partly flooded by storm surge during a typhoon.
Water enters through the lower part of the container, and rust and wet damage are found at destination. The estimated cargo loss is JPY 2.6 million.
The shipping line explains that the loss resulted from a natural disaster. The shipper argues that the terminal should have moved the container to a higher or safer area because a storm-surge forecast had been issued.
The freight forwarder should review the storm-surge information, port and terminal suspension notice, CY delivery time, yard position, flood extent, EIR, container doors and floor and damage photographs.
Even where the storm surge was unavoidable, the available protective measures, feasibility of moving the container and treatment of other containers in the same yard may be relevant.
If the container had a pre-existing hole or defective door seal, both the storm surge and the container condition may have contributed to the damage.
The freight forwarder should not immediately characterize the loss as either natural disaster or terminal fault. It should notify the insurer, carrier, terminal and surveyor and preserve contemporaneous evidence.
When to Consult a Maritime Lawyer
Routine weather review, schedule amendment or delivery rescheduling may not require immediate legal advice. Consultation with a lawyer experienced in maritime transport and cargo insurance should nevertheless be considered in the following situations:
- The carrier relies on heavy weather, perils of the sea or force majeure as a defence
- The severity, foreseeability, weather routing or navigational decision is disputed
- Seaworthiness, hatch condition, reefer equipment, container equipment or vessel management is disputed
- Vessel stowage, lashing, cargo securing or packaging responsibility is complex
- A substantial wet-damage, cargo-shifting, temperature, storm-surge or container-loss claim arises
- The responsibilities of the shipping line, NVOCC, prime freight forwarder, overseas agent, terminal, warehouse, shipper or cargo owner are complex
- The insurer raises delay, inherent vice, natural deterioration, temperature management or an exclusion
- General average or salvage costs are declared or demanded
- A claim-notice deadline, objection period or time bar is approaching
- A party requests an admission of liability, indemnity agreement, guarantee, settlement or waiver

Summary
Weather information and maritime transport risk is not merely the review of a weather forecast. It is the operational use of typhoon, low pressure, wind, waves, storm surge, fog and related information in vessel, port, terminal, cargo, insurance and liability management.
Meteorological warnings and forecasts, port and terminal notices, shipping line or NVOCC communications, vessel movement and cargo-specific records have different functions.
Weather information is important evidence of the existence and severity of weather conditions. It does not alone establish the cause of individual delay, cargo damage, carrier exemption or insurance coverage.
Where heavy weather occurs, the parties should determine whether the vessel is at sea, waiting for port entry or berthing, affected by handling suspension, or delayed at the CY, CFS, gate, customs or delivery stage.
Operational effects may remain after the weather improves because of backlogs involving vessels, containers, vehicles and warehouses. Revised ETD and ETA should therefore be reviewed together with handling, terminal availability, pickup, connection and delivery.
Where cargo damage is suspected, delay, physical damage, natural deterioration, inherent vice, packaging, securing, equipment and temperature management should be separated.
Official weather material, port and terminal notices, vessel movement, B/L, EIR, photographs, temperature and power records, inspection and communications should be preserved promptly.
The responsibility of a freight forwarder cannot be determined solely from its involvement with weather or delay information. Its status as the Contracting Carrier or Actual Carrier, its position under the Standard Five Classifications, the actual scope of entrusted work, review and notice times, transport documents, applicable terms and response after the incident became known must be examined separately.
The existence of weather-related loss or additional cost and the right to recover it from the shipping line, NVOCC, freight forwarder, shipper, cargo owner, terminal or another party are separate issues.
