Even if Container Sweat occurs, it does not automatically mean the container owner or shipping line is liable.
If the container itself has no holes or leaks, and the internal water vapor originates from the cargo, packaging material, or wooden pallets, then moisture protection design, moisture content, and stowage conditions become critical factors.

When the cargo is sensitive to moisture, condensation, temperature differences, rust, or mold, it is important to clearly specify the necessary packing, moisture-proofing, drying, temperature and humidity control, and storage conditions.
If the cargo owner has not explained the cargo's hygroscopicity, high moisture content, special unpacking conditions, or required amount of desiccant, the question arises whether the freight forwarder or the handling operator could have reasonably recognized these risks.
Moreover, vague instructions such as "include desiccants" or "be careful of moisture" create ambiguity regarding the scope of responsibility.
It is desirable to specify as concretely as possible—with available information—the type and required quantity of desiccants, their placement, specifications of moisture-proof bags, sealing methods, volume of air inside the packaging, transportation duration, anticipated route, and the pallets used.
Freight Forwarder's Duty to Communicate and Arrange
Even if the freight forwarder does not perform the packaging work directly, the critical issue is whether the cargo information and moisture protection requirements received from the cargo owner were accurately conveyed to the warehouse operator, packer, vanning contractor, and trucking company.
If the freight forwarder had received necessary instructions from the cargo owner but failed to communicate them to the relevant parties, a failure in information transmission may be examined as a potential negligence.
Even when the freight forwarder or NVOCC arranges containers, warehousing, packaging, or vanning, they do not automatically assume full packaging responsibility.
The actual responsibility is determined based on factors such as the scope of engagement, contract terms, work instructions, expertise, the status of cargo information provided, selection of contractors, level of on-site involvement, and whether abnormalities could have been recognized.

Example 1: Ceiling Water Droplets Present but No Holes in the Container
Consider a case where metal products are transported in a standard dry container, and upon arrival, water droplets are found on the container ceiling with rust present on the top surface of the cargo.
If there are no holes or leaking points on the container roof, sidewalls, or doors, and the moisture content of the wooden packaging and pallets loaded inside is high, the cause is likely not external rainwater ingress but rather internal moisture such as Container Sweat or Container Rain.
However, the mere fact that water droplets are present on the ceiling does not conclusively determine the application of Clause 4.3 or Clause 4.4.
It is necessary to verify whether the cargo was shipped in good condition, whether the anti-corrosion packaging was appropriate for typical marine transport, the dryness of the wood, temperature variations along the route, the transit period, and the humidity inside the packaging.
The focus of assessment is not simply the presence of condensation, but the source of moisture that caused the condensation and whether the moisture-proof design was suitable for normal transport conditions.
Specific Example 2: Coexistence of Container Damage and Insufficient Moisture Protection
Suppose there is minor damage to the container sidewall, with cargo near the damage area heavily wet, and cargo in a separate area showing minor mold growth.
The heavy wetting near the sidewall may be due to moisture intrusion from outside.
On the other hand, the mold on the distant cargo may result from increased humidity inside the container caused by the moisture intrusion combined with inadequate moisture protection packaging or ventilation design.
