外航貨物海上保険のその他関連約款
This clause shall be paramount and shall override anything contained in this insurance inconsistent therewith.
1 Notwithstanding any provision to the contrary contained in the contract of insurance or the Clauses referred to therein, it is agreed that in so far as the contract of insurance covers loss of or damage to the subject-matter insured caused by
any act of terrorism being an act of any person acting on behalf of, or in connection with, any organisation which carries out activities directed towards the overthrowing or influencing, by force or violence, of any government whether or not legally constituted or
any person acting from a political, ideological or religious motive,
such cover is conditional upon the subject-matter insured being in the ordinary course of transit and, in any event, SHALL TERMINATE:
either
1.1 as per the transit clauses contained within the contract of insurance,
or
1.2 on completion of unloading from the carrying vehicle or other conveyance in or at the final warehouse or place of storage at the destination named in the contract of insurance,
1.3 on completion of unloading from the carrying vehicle or other conveyance in or at any other warehouse or place of storage, whether prior to or at the destination named in the contract of insurance, which the Assured or their employees elect to use either for storage other than in the ordinary course of transit or for allocation or distribution, or
1.4 when the Assured or their employees elect to use any carrying vehicle or other conveyance or any container for storage other than in the ordinary course of transit,
or
1.5 in respect of marine transits, on the expiry of 60 days after completion of discharge overside of the subject-matter insured from the oversea vessel at the final port of discharge,
1.6 in respect of air transits, on the expiry of 30 days after unloading the subject-matter insured from the aircraft at the final place of discharge,
whichever shall first occur.
2 If the contract of insurance or the Clauses referred to therein specifically provide cover for inland or other further transits following on from storage, or termination as provided for above, cover will re-attach, and continues during the ordinary course of that transit terminating again in accordance with clause 1.

この約款は至上のものとし、この保険に含まれたこれと抵触する他の一切の規定に優先する。
１ この保険契約に含まれる、もしくはこの保険契約において引用される条項に含まれる反対の規定にかかわらず、この保険契約において、
一切のテロ行為、すなわち、合法的にあるいは非合法に設立された一切の政体を、武力または暴力によって転覆させあるいは支配するために仕向けられた活動を実行する組織のために活動し、あるいはその組織と連携して活動する者の行為
政治的、思想的、または宗教的動機から活動する一切の者による保険の目的物の滅失または損傷が担保される場合、
当該担保は保険の目的が通常の輸送過程にある間であることを条件とし、かつ、いかなる場合においても
1.1 この保険契約に規定された輸送約款に従うか、
または
1.2 この保険契約で指定された仕向地の最終の倉庫または保管場所において、輸送車両またはその他の輸送用具からの荷卸しが完了した時か、
1.3 この保険契約で指定された仕向地到着前にあると仕向地にあるとを問わず、被保険者もしくはその使用人が、通常の輸送過程以外の保管のため、または割当もしくは分配のためのいずれかに使用することを選ぶその他の倉庫もしくは保管場所において、輸送車両またはその他の輸送用具からの荷卸しが完了した時、または
1.4 被保険者もしくはその使用人が、通常の輸送過程以外の保管のため、輸送車両もしくはその他の輸送用具またはコンテナを使用することを選んだ時か、または
1.5 海上輸送について、最終仕向港における航洋船舶舷側での保険の目的物の荷卸完了後60日を経過するか、
1.6 航空輸送について、最終仕向地における航空機からの保険の目的物の荷卸後30日を経過するか、
その何れが先に生じても、その時に終了することが、ここに合意された。
2 この保険契約、またはこの保険契約において引用された条項において、保管または上に規定された担保終了後の、国内のもしくはその他の継搬中を特別に担保している場合には、担保は再開し、輸送の通常の過程にある間継続するが、上記第1条の規定によって再度終了する。

協会放射能汚染、化学兵器、生物兵器、生物化学兵器および電磁気兵器免責約款
This clause shall be paramount and shall override anything contained in this insurance inconsistent therewith
1. In no case shall this insurance cover loss damage liability or expense directly or indirectly caused by or contributed to by or arising from
1.1 ionising radiations from or contamination by radioactivity from any nuclear fuel or from any nuclear waste or from the combustion of nuclear fuel
1.2 the radioactive, toxic, explosive or other hazardous or contaminating properties of any nuclear installation, reactor or other nuclear assembly or nuclear component thereof
1.3 any weapon or device employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter
1.4 the radioactive, toxic, explosive or other hazardous or contaminating properties of any radioactive matter. The exclusion in this sub-clause does not extend to radioactive isotopes, other than nuclear fuel, when such isotopes are being prepared, carried, stored, or used for commercial, agricultural, medical, scientific or other similar peaceful purposes.
1.5 any chemical, biological, bio-chemical, or electromagnetic weapon.

1. いかなる場合もこの保険は、直接・間接に、下記による、または下記を一原因とする，または下記から生ずる滅失・損傷・責任または費用を担保しない。

この免責規定は、商業用、農業用、医療用、化学用またはその他の平和的利用のため作られ、輸送、保管、使用される場合には適用されません。

戦争約款を補填する内容となっています。過去の重大事故(原子力発電所の事故や米国同時多発テロ)により、英国の再保険市場により制定されました。核エネルギー利用施設や核燃料物質等の事故に起因する損害、生物兵器、化学兵器、電磁兵器による損害、または費用損害、賠償損害についても免責規定をしています。
Notwithstanding anything contained herein to the contrary, it is specially understood and agreed that the words “arising from risks covered under 1.1 above” in clause 1.2 of the Institute War Clauses (Cargo) shall be deleted, and that this insurance shall cover loss or damage to the subject-matter insured caused by piracy and the consequences thereof or any attempt thereat.

Where the loss has occurred on a part of the goods and the Company pays the proportion of the insured amount relating to such part, the provisions in the preceding paragraph apply to that part.
【要 旨】
貨物が全損となった場合において、当会社が保険金額の全部を支払ったときは、当会社は、保険金額の保険価額に対する割合で、貨物について被保険者が持っている権利を取得します。ただし、当会社がその権利を取得しない旨の意思を表示して保険金を支払ったときは、この限りではありません。
貨物の一部について損害が生じ、当会社がその部分に対する保険金額の割当額の全部を支払ったときは、その部分について前項の規定を準用します。

残存する貨物の所有権は、保険会社からの取得の意思表示がない限り、被保険者に帰属する旨を規定しています。
協会戦争解約約款
The cover against war risks (as defined in the relevant Institute War Clauses) may be cancelled by either the Underwriters or the Assured except in respect of any insurance which shall have attached in accordance with the conditions of the Institute War Clauses before the cancellation becomes effective. Such cancellation shall however only become effective on the expiry of 7 days from midnight of the day on which notice of the cancellation is issued by or to the Underwriters.
